Version 2026-10-20.2 · Effective October 20, 2026

Terms of Service

The agreement for your account and every check you ask us to send.

These Terms of Service (“Terms”) are an agreement between you and JustSendTheCheck LLC, doing business as Just Send the Check (“we,” “us,” or “our”). They govern our website, account portal, APIs, AI-agent connections, check preparation and mailing, payment collection, and related support (together, the “Service”).

Read these Terms before accepting them. You accept by checking an agreement box and submitting it, or by expressly instructing an agent to communicate your acceptance of the identified version through a supported sign-up flow. An agent may not invent your consent. Visiting the site alone does not authorize a payment. Our Privacy Notice explains how we handle personal information.

1. Eligibility and permitted use

You must reside in the United States, be at least 18 and old enough to enter a binding contract where you live, and use the Service for your own lawful personal, family or household bills. A payee may be a business; the sender account is for an individual. You must provide your accurate legal name, a working email address and any information reasonably needed to process your request or comply with law. You may use only a payment method you are authorized to use.

Do not use the Service for business disbursements, payroll, collections for others, cash advances, self-payments, moving funds between accounts you control, or general person-to-person transfers unrelated to a genuine bill. Do not use it for money laundering, sanctions evasion, gambling prohibited by law, illegal goods or services, scams, counterfeit checks, harassment, or another unlawful purpose. Do not split transactions or create accounts to evade limits or safeguards.

We may restrict availability by location, payee, transaction type or payment method to meet legal, banking, provider or risk requirements. Availability of an API or successful creation of a draft does not mean we have accepted a payment instruction.

2. What the Service does

You provide the payee, U.S. mailing address, amount, purpose and any memo or reference information. After the required confirmation, authorization and payment, we arrange printing and mailing of a U.S.-dollar paper check drawn on our designated bank account. Your payment to us covers the check amount and disclosed fees. The payee receives our check, rather than a check drawn directly on your personal account.

We are not a bank. Using the Service does not open a deposit, savings, escrow or investment account for you, create a stored balance, or earn interest. We do not promise that money paid to us has pass-through deposit insurance in your name. FDIC insurance does not protect against the failure of a nonbank service provider. Nothing in these Terms waives a legal obligation to safeguard funds.

We arrange the payment you instruct; we do not determine whether you owe the bill, resolve your underlying dispute with the payee, or act as the payee's authorized collection agent merely because you name them. Paying us, mailing a check, and a postal delivery scan do not by themselves establish that your bill has been paid or credited. Confirm acceptance and application of the payment with the payee.

3. Your account and security

Protect your email, sign-in methods, authenticator, backup codes, connected agents and payment-wallet access. Do not share credentials or approve an unexpected prompt. Tell us promptly if you suspect an unauthorized connection, payment or account change, and contact your bank or payment provider where appropriate. Your statutory rights concerning unauthorized payments are preserved.

Website check approval requires a verified sign-in and a second-factor verification within the preceding 10 minutes. Enable an authenticator in your account's Security settings and keep backup codes safely. A social sign-in or a passkey sign-in alone does not satisfy this website approval requirement. A supported wallet payment uses the separate authorization process described below.

4. Connected AI agents and developers

When you connect an agent, you authorize its supported access to your account, including preparing and editing drafts, saving payees, supplying documents and return-address instructions, reading check history and evidence, canceling eligible checks, and reporting problems. An agent may receive information about earlier checks in the account, not just a check it created. Connect only agents you trust. Their services and handling of information are governed by their own terms and privacy practices.

Review the payee's name, full mailing address, amount, purpose, memo, supporting documents and total charge before confirming. AI output may be inaccurate, incomplete or influenced by malicious content in an invoice or website. Confirmation in chat records your instructions but does not, by itself, authorize us to charge you. Changing a confirmed draft requires confirmation again.

For website checkout, you personally approve the displayed check and then authorize payment. Where supported, you may instead authorize a spend through your Stripe Link agent wallet, and your agent submits the resulting payment credential for that confirmed check. The wallet path does not use our website's Clerk second-factor check. Your wallet provider controls its own approval and authentication process. Connecting an agent or accepting these Terms does not give it unrestricted authority to spend.

You can revoke a connection from your account. Revocation prevents future access through that connection; it does not cancel a check already authorized, reverse a settled payment, or erase copies the agent already received. Developers must protect tokens, use only granted permissions, respect rate limits, accurately communicate human instructions, and never bypass human-only endpoints or security controls.

5. Payment authorization, fees and limits

Each new check has a service fee currently set at $4.99, covering standard printing and postage. We charge no payment-method surcharge for bank-account, credit-card, debit-card, prepaid-card or supported Link wallet payments. The service fee is the same regardless of the payment method. Your bank or card issuer may impose its own charges under your agreement with it; we do not set or collect those charges. The total disclosed for your particular payment, including any applicable tax, must be shown before you authorize it.

For example, a $125.00 check with the current service fee totals $129.99 with any supported payment method. A later fee change does not increase the total of a payment already authorized. We do not charge a subscription or automatically authorize another check merely because you used the Service before.

By approving the identified check and completing checkout or the supported wallet authorization, you authorize collection of the disclosed total from the payment method you select and issuance of that check. For ACH, you also give the authorization presented by Stripe in checkout for that particular debit; these Terms do not create a separate recurring-debit mandate. Stripe may verify or connect to your bank to process the payment. We do not need your online-banking password and do not receive it.

Our current standard limits are $500 per check, $500 in a rolling 24-hour period and $1,000 in a rolling 30-day period. Lower account-specific or provider limits may apply. Duplicate checks may be blocked; deliberately overriding a duplicate warning does not relieve you of reviewing the payment.

Card and wallet payments generally enter processing after successful payment; ACH-funded checks enter processing after payment clearance, which commonly takes several business days. Funding, fraud review, outages or bank requirements can delay processing. A payment success message is not a promise of immediate mailing. If a valid authorized payment is later returned or reversed after its check has been paid, you remain responsible for any amount lawfully owed, without double recovery or an undisclosed new debit. This does not impose liability for an unauthorized transfer beyond what law permits.

6. Mailing, delivery and payee acceptance

We use standard U.S. mail to supported U.S. addresses. Delivery dates and tracking events are estimates supplied by providers and may be incomplete or delayed. A delivery scan is not proof of receipt by the intended person, deposit, clearance or credit to your bill. We do not offer a guaranteed arrival or bill-crediting date.

Allow time for payment clearance, printing, postal delivery and the payee's processing. Confirm that the payee accepts a third-party paper check and include any required account or invoice reference. Do not rely on this Service where a cashier's check, certified funds, a particular payment channel or guaranteed legal-deadline delivery is required. You remain responsible for your underlying bill and its due date, subject to any remedies available for our own breach or applicable law.

Checks carry an expiration notice based on a 90-day period. Do not ask the payee to deposit a canceled, voided, replaced or expired check. Contact us if you need help reconciling a replacement or an attempted late deposit.

7. Cancellation, refunds, stop payments and replacements

The remedies below are part of our agreement with you. A “full refund” includes the check amount, service fee and any payment-method fee you paid us. A “check-amount refund” returns the face amount of the check. Any legally required tax adjustment also applies.

Cancellation before printing or failure to issue

If we successfully cancel before printing, or cannot issue the check after collecting payment, we refund the check amount and service fee. A cancellation request is not a confirmed cancellation; printing may already have begun.

Our error, postal loss or damage

For a lost, damaged or incorrectly printed check caused by us or the postal service, you may choose a free replacement or a full refund, including fees, after the original is secured against payment.

Incorrect information you confirmed

For an incorrect payee name or an undeliverable address you approved, we offer a free corrected replacement or refund of the check amount. We retain the service fee for a check already printed and mailed, unless the error was ours or a greater refund is required by law.

A mailed check you want stopped

If the check has not been paid, you may request a stop. After the bank confirms the void, we refund the check amount and retain the service fee. A check already paid cannot ordinarily be canceled.

A check that remains uncashed

At 90 days after mailing, we initiate a void of an uncashed check and refund the check amount after bank confirmation. We retain fees for the completed printing and mailing service unless another applicable remedy requires their refund. The printed expiration notice alone is not confirmation that the bank has stopped payment.

A stolen, altered or fraudulently deposited check

Report suspected fraud promptly. We investigate with the bank. For a confirmed unauthorized deposit or alteration by someone else, we arrange a replacement or refund all amounts you paid, including fees. If the check has cleared, our team reviews the paid item and files the bank claim before arranging that remedy; recovery from the bank is not a condition to our promised remedy.

Once a check has been issued, a refund or replacement generally waits until the original is canceled by the printer or its void is confirmed by the bank. A request to stop payment, or the printed expiration date, cannot guarantee that a check already presented will not clear. Confirmed fraud involving an already-paid check follows the separate investigation process above. We will not both refund and replace the same payment or pay the same remedy twice.

For returned or lost mail, we notify you of the available options and generally give you 14 days to choose; the notice identifies the default refund if you do not respond. If a payee reports nonreceipt or damage, we notify you and may arrange a free replacement to the same address unless you object within 5 days. You authorize that limited replacement process by accepting these Terms. A change to the payee name or mailing address requires your separate approval. A replacement does not create a new charge.

We send reminders for an uncashed check around days 30 and 60. Tracking, bank reports and manual review may affect when an issue is detected or resolved. Contact us if a payment appears overdue; do not send another payment solely because a tracking update is missing.

Refunds normally return through the original payment method. Posting time depends on the processor and bank. If the original method cannot receive the refund, we work with you to arrange another lawful method after verifying entitlement. We do not take ownership of money owed to you because a refund fails or you do not respond. Unclaimed amounts are handled under applicable unclaimed-property law, including legally required notices and remittance to the proper authority.

8. Errors, unauthorized activity and payment disputes

Contact support@justsendthecheck.com with the check reference, date, amount and a description of the issue. Do not email passwords, authenticator codes or full card or bank-account numbers. We may request reasonably necessary documents or declarations to investigate. A payee may also contact support with the reference printed on the check.

You may contact your bank, card issuer, payment provider, regulator or law enforcement directly. You do not have to contact us first or wait for our investigation before exercising legal dispute or error-resolution rights. Nothing here shortens a statutory reporting deadline, waives rights under the Electronic Fund Transfer Act, Regulation E, the Fair Credit Billing Act or another applicable consumer law, or makes our records conclusive against you.

We may temporarily pause new payments while investigating suspected fraud or a disputed funding payment. We may seek to void an unpaid check, accept a funding dispute or submit relevant transaction evidence to the processor. A dispute outcome is determined through the applicable process. We coordinate refunds and dispute credits to avoid duplicate recovery while preserving your rights.

9. Documents, payee information and records

You retain your rights in invoices, images, files, links, instructions and other content you provide. You grant us a limited permission to receive, copy, store, process and share that content as reasonably necessary to provide the Service, investigate problems and meet legal obligations, as described in the Privacy Notice. You must have authority to provide it. A link submitted for a bill may be fetched and archived; do not submit credentials, unrelated sensitive information, or a link you lack permission to share.

We keep transaction and authorization records, including instructions, confirmations, check details, payment references and events. Some events form a tamper-evident hash chain. That helps identify changes; it does not prove that an agent's statement was accurate or eliminate your right to challenge a record. Save the records you need, and ask support for corrections or copies.

The payee, printer, postal service and banks receive information required to issue, deliver and process a check. A memo or sender address may be visible on the check or envelope. Avoid unnecessary health, financial-account or other sensitive details. Service providers and your chosen agents are further described in our Privacy Notice.

10. Service providers and acceptable access

We use providers including Clerk for authentication, Stripe for payments and supported wallets, and Lob for printing and mailing. A provider may present its own agreement for the service you use directly. Those agreements do not eliminate our obligations to you under these Terms. We do not promise a provider has verified the validity of your bill or the accuracy of every payee instruction.

We grant you a limited, nonexclusive, revocable permission to access the Service for its permitted purpose. We retain our software, design, trademarks and other intellectual-property rights. Do not impersonate others, access another account without permission, submit malware, interfere with the Service, harvest other users' information, or circumvent authentication, payment confirmation, rate limits or fraud controls. This does not prohibit activity that applicable law expressly permits.

By affirmatively accepting these Terms, you consent to receive this agreement, payment authorizations, disclosures, receipts, check updates, account notices, dispute communications and other Service records electronically, through the website, your account, your provided email address or a supported payment flow. Your intentional electronic acceptance or approval may have the same legal effect as a signature on paper. Consent to electronic records is not consent to marketing or to an additional payment.

You need internet access, an email account you can access, a current browser supporting HTTPS, cookies and JavaScript, and the ability to view HTML and PDF records and save or print them. By accepting through a supported flow, you confirm you can access and retain the linked Terms. Save or print this page for your records. If you cannot access a required electronic record, contact us before proceeding.

You may request a paper copy of a Service record, update your contact information, or withdraw electronic-delivery consent by emailing support or writing to the address below. We do not charge for those requests. Withdrawal applies after we have had a reasonable opportunity to process it and does not invalidate earlier consent, an authorized transaction or a record already delivered. Because this is an electronic service, withdrawal may prevent new transactions or require account closure; we will continue handling existing checks, refunds and legally required notices.

If a change to hardware or software requirements creates a material risk that you cannot access or retain required records, we will provide the revised requirements and seek renewed consent where required by law. If a particular disclosure requires a separate consent procedure, we will use that procedure; this clause does not replace it.

12. Suspension and closing your account

You may stop using the Service and request account closure through support. Disconnecting an agent or deleting an authentication profile alone does not necessarily close the Service account. See account and data deletion.

We may decline a request, suspend new activity or close an account for a material breach, suspected fraud, security risk, legal or provider requirement, or discontinued service. Where lawful and practical, we will explain the restriction and how to contact support. Suspension or closure does not forfeit money owed to you or cancel our refund obligations. We will address outstanding checks and refunds and retain records where necessary and lawful. Terms concerning completed transactions, records, disputes or continuing obligations survive closure.

13. Warranties and limits of responsibility

We will use reasonable care in providing the Service. We do not warrant uninterrupted availability, error-free AI output, guaranteed postal delivery, a payee's acceptance of a third-party check, or a particular result in your dispute with a payee. Except for express promises in these Terms and warranties that law does not allow us to exclude, the Service is provided on an “as available” basis without implied warranties of merchantability, fitness for a particular purpose or noninfringement.

To the extent permitted by law, neither party is liable to the other for indirect, special, incidental, consequential or punitive damages arising from the Service. Our aggregate liability for other claims is limited to the greater of $100 or the service and payment-method fees you paid us in the 12 months before the event giving rise to the claim.

These exclusions and the cap do not limit our obligation to account for check principal, pay a promised refund or replacement, correct an unauthorized or erroneous payment as required by law, or answer for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. They do not override a nonwaivable consumer remedy. Some jurisdictions do not permit particular exclusions or limits; only lawful limits apply to you.

To the extent permitted by law, you are responsible for direct losses and reasonable third-party claim costs caused by your intentional fraud, knowing submission of unauthorized payment instructions, or willful unlawful use of the Service. This does not require you to reimburse us for our own wrongdoing, ordinary use of the Service, or an unauthorized transfer for which you are not legally responsible. We will notify you of any such claim and allow a reasonable opportunity to participate; no settlement may impose an admission or nonmonetary obligation on you without your consent.

14. Governing law and disputes

These Terms are governed by applicable U.S. federal law and the laws of Texas, excluding conflict-of-laws rules, except that mandatory consumer protections in your state of residence continue to apply. A dispute may be brought in a court with jurisdiction, including an eligible small-claims court. These Terms do not impose mandatory arbitration, a class-action waiver, or an exclusive forum that deprives you of a forum available under applicable consumer law.

Support is available to try to resolve concerns informally. Contacting support is voluntary and does not postpone or restrict your right to file a claim, make a regulatory complaint or dispute a payment.

15. Changes and general provisions

We will identify revised Terms by version and effective date and provide notice of material changes by email or in the Service before they apply. Where affirmative consent is required, we will obtain it before a new payment. Changes do not retroactively reduce a remedy for an earlier transaction or alter a dispute that has already arisen without your express agreement. You may decline revised terms and stop initiating new payments while existing checks and refunds are resolved.

These Terms, your specific payment authorization and applicable transaction disclosures form our agreement about the Service. A specific, expressly agreed transaction term controls over a conflicting general provision, subject always to applicable law. A provision found unenforceable is limited or severed only as necessary; the remainder continues. Failure to enforce a term once is not a waiver. You may not transfer your account without our consent. We may transfer this agreement with a business transfer only if the successor assumes our obligations and your nonwaivable rights are preserved. No term creates rights for an unrelated third party or waives a payee's rights arising independently under check law.
